This is a serious issue I'm having (try not to laugh).

I rent my movies from a "mom and pops" store (Because of the good deals 1.50 and selection of Porn). Out of all the dvd's ive rented, (>100) they said I never returned the 5th element! It had been a couple months since the rental, I just found out about this and now they sent the claim to collections ($100<). They supposedly sent me notices, but I never recieved one.

Anyway, I want some input on how to go about this. I know I returned it and I also know that, during the time I had returned it, the store had been undergoing some remodeling. From the attitude of the employees, they believe thier system is fool proof. But I think thiers something funny going on. Anyway, sending the issue to collections without letting me know seems pretty shady already.

Advice?

ask them the DVD number, and go find it the shelves.

Can't do that. The lisence for a rental DVD is not the same as a for home use DVD.

I offered to do that but they want the 100+ dollars for the time it had been out and its now at collections.

I've read up on this Law (FDCPA) stating that I can dispute the collection (within 30 days). Hopefully its not gone over.

They do actually have to notify you that it's missing and will begin charging you per day/week/whatever for them to be able to get that much. I'm pretty sure that they are not able to charge more than the actual value of the property in question.

So, if the liscense is different, then buy a used one from some other rental store like blockbuster, which would then have the same liscense. These guys are just trying to screw you.

i wish i could steal the 5th element, shes soooo hot.

in all seriousness though. you have 2 choices as I see it, pay the money and never go back (sucks for you), or get a person with a legal background to look into it and tell them to fuck off with a nice strongly worded letter (sucks for you again cause youll probably have to pay legal fees). Having a lawyer in the family is quite convienent for me, but I get the feeling your not as lucky.

Sorry man, this really does suck.

Seek some free legal advise if you can, in the UK we have the citizens advise bureau. Not sure if you have anything similar across the pond.
